It's happening again: Epic Games is facing a fresh lawsuit over Fortnite's "Touching the Sky" emote, which choreographer Felix Burgos says is being used in the game without his permission.

Choreographer Felix Burgos has sued Epic Games, claiming they made a 'Fortnite' emote from dance moves he created for a Rauw Alejandro music video.

The emote was introduced to Fortnite earlier this year, and was even named “Touching the Sky,” like Alejandro’s song.

Epic called it a coincidence, but the Ninth Circuit disagreed, ruling that the emote might actually infringe on protected choreography. Epic quietly settled in 2024.
